Zentera Systems, Inc. (“Zentera”) Privacy Policy describes the privacy practices of Zentera’s websites, products, online services, and apps (the Services”) pursuant to the following terms relating to the collection and use of the personally identifiable information (“PII”) of its users (“Users”) of its website (the “Site”):


WHAT KINDS OF PERSONALLY IDENTIFIABLE INFORMATION DO WE COLLECT FROM USERS?


Zentera does not collect any PII from Users who have not registered and established an account on the Site. The only exception to the foregoing statement is that Zentera requires such Users to provide their name and email address if they want to download whitepapers from the Site. When a User registers and establishes an account on the Site, Zentera collects the User’s names, email address, company name, the country where the company is located and the User’s telephone number (if given). In order to use Zentera’s Services, Users must register.


HOW DOES ZENTERA USE THE PII THAT IT COLLECTS FROM USERS?


Zentera uses the PII that it collects from non-registered Users and from Users who have registered and then established free accounts to attempt to contact such Users and convince them to become paying customers. Zentera also uses the PII that it collects from registered Users to provide them with login credentials.


DOES ZENTERA SHARE THE PII THAT IT COLLECTS FROM USERS WITH THIRD PARTIES?


Currently, Zentera does not share the PII it collects from Users with third parties. In the future, Zentera may decide to share the PII it collects with third parties. Before it does so, Zentera will post changes to this Privacy Policy to announce those changes.


HOW LONG DOES ZENTERA RETAIN THE PII THAT IT COLLECTS FROM ITS USERS?


Zentera may retain the PII that it collects from its Users indefinitely. Zentera has not established a policy for how long it will retain the PII it collects.


CAN USERS REQUEST THAT ZENTERA PURGE THEIR PII ZENTERA HAS RETAINED?


Yes. Users can send an email to privacy@zentera.net to request that Zentera purge their PII from Zentera’s servers and Zentera will comply with that request within 90 days.


CAN USERS REVIEW THE PII THAT ZENTERA HAS COLLECTED AND RETAINED ABOUT THEM?


At the present time, Zentera does not offer Users a means to review the PII that Zentera has collected and retained about them.


DOES ZENTERA’S SITE PLACE COOKIES ON THE USERS’ MACHINES? IF SO, WHAT INFORMATION DO THOSE COOKIES COLLECT AND HOW IS THAT INFORMATION USED?


Zentera subscribes to Google’s Google Analytics service. That service places cookies on the machines of those who visit the Site. The cookies are used to generate detailed statistics about the Site’s traffic and traffic sources measure conversions and sales. The cookies that are placed store anonymous information such as whether the visitor has been to the site before (new or returning visitor), the timestamp of the current visit, and the referrer site or campaign that directed the visitor to the page (e.g. search engine, keywords, banner or email). Zentera stores the data received from Google Analytics indefinitely. But the cookies placed by the Google Analytics service do not collect, store or transmit PII; and the data received from the service does not contain any PII either. Users are free to disable the cookies through their browser settings.


WHAT SECURITY MEASURES DOES ZENTERA EMPLOY TO PROTECT USERS’ PII FROM UNAUTHORIZED ACCESS OR USE?


All PII that Zentera collects and retains from Users is password protected. Zentera also employs a firewall and SSL encryption to protect Users’ PII. Zentera does not employ any other measures to protect Users’ PII.


HOW CAN USERS CONTACT ZENTERA WITH QUESTIONS ABOUT PRIVACY-RELATED ISSUES?


Users having questions about Zentera’s privacy-related practices and procedures may contact Zentera by email at privacy@zentera.net or by telephone at (408) 914-2699.


IS ZENTERA’S SITE INTENDED TO BE USED AND ACCESSED BY CHILDREN UNDER THIRTEEN YEARS OF AGE?


Zentera’s Siteand the Service are intended to be used only by adults. Zentera will terminate the access to the Service of any User who Zentera learns is under age 13.


DOES ZENTERA RESPOND TO “DO NOT TRACK” REQUESTS FROM ITS USERS?


At this time, Zentera does not respond to “Do Not Track” requests.


HOW WILL ZENTERA INFORM USERS OF CHANGES TO THIS PRIVACY POLICY?


Zentera reserves the right to make changes to this Privacy Policy at any time. When Zentera does make changes, it will post a revised Privacy Policy containing those changes and including a new effective date at Zentera.net/privacy.

The revised Privacy Policy will become effective upon posting. Users are responsible for checking the Privacy Policy frequently to stay aware of Zentera’s most current Privacy Policy and practices.

By visiting the Site and accessing the services made available by Zentera through the Site (the “Services”), you agree to comply with and be bound by the following Terms of Service and any documents referenced herein (the “Terms”). Certain Zentera products and services are subject to additional or different terms (the “Additional Terms”).

Account Requirements and Restrictions:
• When using the Services, you represent that you are of sufficient age to form legally binding contracts. Our Site is not designed to solicit or collect information of any kind from persons under the age of 13, and we do not knowingly collect any information from persons under the age of 13.


• You are responsible for maintaining the security of your account and password. Zentera cannot and will not be liable for any loss of information or security breaches that result from your failure to comply with security obligations.


• Zentera may suspend or terminate your account or refuse any and all current or future use of the Services for any reason at any time.


• Zentera reserves the right to discontinue or change the Services, temporarily or permanently, at any time, without notice.


• Zentera reserves the right to change its prices for any Services at any time, without notice, including, without limitation, adding limitations on free use of the Services, thresholds for fees, and minimum payments.


• You agree to provide accurate information when registering for or interacting with the Services. It is your responsibility to ensure that your contact information is correct in your account. Failure to provide accurate contact information may result in you not receiving access to the Services. If you provide fraudulent, misrepresented, or otherwise untruthful information, we may terminate your account and prevent you from using the Services in the future.


Privacy and Communications:
By registering for or using the Site or the Services, you represent that you have read and accepted the terms of the Zentera privacy policy available at www.zentera.net/privacy (“Privacy Policy”). By agreeing to these Terms, you consent to Zentera’s collection, use, and disclosure of information associated with your account and use of the Services in accordance with the Privacy Policy. In addition, you acknowledge and agree that Zentera may monitor your use of the Services, including information in your account, and use such information as described in the Privacy Policy. By creating an account to use the Services, you expressly agree that Zentera representatives may contact you from time to time regarding Zentera sponsored events and Zentera’s products and services.


Use and Content Restrictions:
General Restrictions. Viewing, printing, or downloading any content, video, audio, graphic, form, or document from the Site or Services grants you only a revocable, nonexclusive license for use solely by you for personal, noncommercial purposes. No part of any content, graphic, form, or document may be reproduced in any form other than for your personal, noncommercial use. Content Restrictions. Audit and Cooperation:
Zentera reserves the right to verify your compliance with this Agreement. If we audit, you will provide information or other materials reasonably requested by us. We monitor the overall performance and stability of the infrastructure of the Site and Services. You may not block or interfere with that monitoring. In the event that we reasonably believe a problem with the Site or Services may be attributable to your use or your content, you agree you will cooperate with us to identify the source of that problem.


Fee Estimates:
Zentera may provide you estimates of the fees and charges associated with third party products and services. Zentera may not be able to estimate all purchasing options and discounts available from such third parties, and estimations may be inaccurate. YOU ACKNOWLEDGE AND AGREE THAT THESE ARE ESTIMATES ONLY AND THAT THE ACTUAL FEES AND CHARGES MAY DIFFER OR CHANGE.


Copyright Ownership:
Subject to the limited rights expressly granted herein, Zentera reserves all rights, title, and interest in and to the Site and Services, including all related intellectual property rights. Copying, redistribution, use, or publication by you of any part of the Site or Services, except as allowed under “Limited Right to Use” below, is strictly prohibited. You may not use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm, or methodology to access, acquire, copy, or monitor the Services.


Trademark Information:
“Zentera”, “CoIP” “Guardia Fabric”, “zAccess”, “zCenter”, “zChamber”, “zGDB”, “zNet”, “zSafe”, “zShell” are trademarks and service marks of Zentera Systems, Inc. All other trademarks appearing on the Site or Services are the property of their respective owners.


Copyright Infringement:

If you believe that your work has been copied in a way that constitutes copyright infringement on the Site or through the Services, please provide Zentera’s copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Zentera that your copyrighted material has been infringed.

• A description of the copyrighted work that you claim has been infringed upon

Assignment:
Zentera may assign these Terms to an entity (i) that controls, is controlled by, or is under common control with Zentera or (ii) which purchases all or substantially all of Zentera’s assets or stock. Your right to use the Site and the Services is not assignable or transferable.


WARRANTY DISCLAIMER:
THE SITE AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ZENTERA AND ITS AFFILIATED PARTIES DISCLAIM ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, OR MERCHANTABILITY. LIMITATION OF LIABILITY:
IN NO EVENT SHALL ZENTERA OR ITS AFFILIATED PARTIES BE LIABLE FOR ANY LOSS OF USE, LOSS OF PROFITS, INTERRUPTION OF BUSINESS, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING HEREFROM OR RELATED HERETO IN ANY CAUSES OF ACTION OF ANY KIND, EVEN IF ZENTERA WAS ADVISED  OF THE POSSIBILITY OF SUCH DAMAGES OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF SUCH DAMAGES. ZENTERA’S AGGREGATE LIABILITY TO YOU FOR EVERY REASON UNDER THESE TERMS SHALL BE LIMITED TO US $50.00. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, YOU OBTAIN FROM US FROM  OR THROUGH THE SITE OR SERVICES SHALL CREATE ANY WARRANTY, REPRESENTATION, OR GUARANTEE NOT EXPRESSLY STATED IN THESE TERMS.

The Site and Services may now, or hereafter, contain links to third-party websites. We do not control, investigate, monitor, or check such websites. We are not responsible for  the content in or opinions expressed at such websites, and do not investigate, monitor, or check the same. If you decide to leave the Site or Services and access any third-party websites, you do so at your own risk.


Communications:
All comments, feedback, information, ideas, or materials that you submit through or in association with the Site or the Services shall be considered non-confidential. Export Compliance:
The Services and derivatives thereof may be subject to export and import laws and regulations of the United States and other jurisdictions. You represent that you are not  named on any U.S. government denied-party list. You shall not permit any access or use any Services in a U.S.- embargoed country (currently Cuba, Iran, North Korea, Sudan,  and Syria) or in violation of any export or import law or regulation of any jurisdiction.


Miscellaneous:
Any cause of action by you with respect to the Services or Site must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All  actions shall be subject to the limitations set forth under “Warranty Disclaimer” and “Limitation of Liability” above. The language in these Terms shall be interpreted as to its  fair meaning and not strictly for or against you or us. Should any part of these Terms be held invalid or unenforceable, that portion shall be construed consistent with  applicable law and the remaining portions shall remain in full force and effect. Dispute Resolution:
These Terms shall be governed by the laws of the State of California, excluding its conflicts of laws principles. The United Nations Convention on Contracts for the  International Sale of Goods does not apply to these Terms. If a dispute arises between you and Zentera, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. In the event of a dispute, we encourage you first to contact Zentera to resolve your problem directly with us. You may contact Zentera regarding  any complaints or disputes at legal@zentera.net.


Except as explicitly provided in these Terms, any dispute or claim relating in any way to your visit to the Site or your use of  the Services, any product offered or provided by or through the Site, or otherwise arising out of or relating to these Terms that cannot be resolved directly between you and Zentera shall be resolved by non-appearance based binding arbitration, rather than in court. Except as otherwise provided in this section (“Dispute Resolution”), this includes any claims based in contract, statute, tort, fraud, misrepresentation or any other legal theory. The Federal Arbitration Act and federal arbitration law apply to these Terms.


Either you or Zentera can initiate an arbitration through the following alternative dispute resolution (“ADR”) provider and rules: the American Arbitration Association (AAA) pursuant to the then-current Supplementary Procedures for Consumer-Related Disputes. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award an individual the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must apply and follow these Terms as a court would. The ADR provider and the parties must also comply with the following rules: (a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, and the specific manner shall be chosen by the party initiating the arbitration; (b) the arbitration shall not  involve any personal appearance by the parties or witnesses unless the arbitrator determines that an in-person hearing is necessary based on the request of one of the parties; and (c) any judgment on the award rendered by the arbitrator shall be final and may be entered in any court of competent jurisdiction.


You and Zentera each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason, a claim proceeds  in court rather than in arbitration, you and Zentera each waive any right to a jury trial and agree to proceed only on an individual basis and not in a class, consolidated, or representative action. The parties hereby appoint the arbitrator the exclusive power to rule on any challenges to the requirement for the use of ADR in these Terms.


You and Zentera also each agree that you or Zentera may bring suit in court to obtain interim or preliminary injunctive relief necessary to protect the rights or property of you, Zentera  or Affiliated Parties, pending initiation and completion of the arbitration.


Except as explicitly provided in these Terms, all claims you bring against Zentera must be resolved in accordance with this Dispute Resolution section. Any claim filed or brought contrary to this Dispute Resolution section shall be considered improperly filed. Should you file a claim contrary to this section, Zentera may recover from you attorneys’ fees and costs up to $1,500 per claim, provided that Zentera first has notified you in writing of the improperly filed claim and you have failed to promptly withdraw the claim.

NSSM: The Non-Sucking Service Manager
Version 2.16, 2012-12-01

NSSM is a service helper program similar to srvany and cygrunsrv.  It can 
start any application as an NT service and will restart the service if it 
fails for any reason.

NSSM also has a graphical service installer and remover.

Usage
-----
In the usage notes below, arguments to the program may be written in angle 
brackets and/or square brackets.   means you must insert the 
appropriate string and [] means the string is optional.  See the 
examples below...


Installation using the GUI
--------------------------
To install a service, run

    nssm install 

You will be prompted to enter the full path to the application you wish 
to run and any command line options to pass to that application.

Use the system service manager (services.msc) to control advanced service 
properties such as startup method and desktop interaction.  NSSM may 
support these options at a later time...


Installation using the command line
-----------------------------------
To install a service, run

    nssm install   []

NSSM will then attempt to install a service which runs the named application 
with the given options (if you specified any).

Don't forget to enclose paths in "quotes" if they contain spaces!


Managing the service
--------------------
NSSM will launch the application listed in the registry when you send it a 
start signal and will terminate it when you send a stop signal.  So far, so 
much like srvany.  But NSSM is the Non-Sucking service manager and can take 
action if/when the application dies.

With no configuration from you, NSSM will try to restart itself if it notices
that the application died but you didn't send it a stop signal.  NSSM will
keep trying, pausing between each attempt, until the service is successfully
started or you send it a stop signal.

NSSM will pause an increasingly longer time between subsequent restart attempts
if the service fails to start in a timely manner, up to a maximum of four
minutes.  This is so it does not consume an excessive amount of CPU time trying
to start a failed application over and over again.  If you identify the cause
of the failure and don't want to wait you can use the Windows service console
(where the service will be shown in Paused state) to send a continue signal to
NSSM and it will retry within a few seconds.

By default, NSSM defines "a timely manner" to be within 1500 milliseconds.
You can change the threshold for the service by setting the number of
milliseconds as a REG_DWORD value in the registry at
HKLM\SYSTEM\CurrentControlSet\Services\\Parameters\AppThrottle.

NSSM will look in the registry under
HKLM\SYSTEM\CurrentControlSet\Services\\Parameters\AppExit for
string (REG_EXPAND_SZ) values corresponding to the exit code of the application.
If the application exited with code 1, for instance, NSSM will look for a
string value under AppExit called "1" or, if it does not find it, will
fall back to the AppExit (Default) value.  You can find out the exit code
for the application by consulting the system event log.  NSSM will log the
exit code when the application exits.

Based on the data found in the registry, NSSM will take one of three actions:

If the value data is "Restart" NSSM will try to restart the application as
described above.  This is its default behaviour.

If the value data is "Ignore" NSSM will not try to restart the application
but will continue running itself.  This emulates the (usually undesirable)
behaviour of srvany.  The Windows Services console would show the service
as still running even though the application has exited.

If the value data is "Exit" NSSM will exit gracefully.  The Windows Services
console would show the service as stopped.  If you wish to provide
finer-grained control over service recovery you should use this code and
edit the failure action manually.  Please note that Windows versions prior
to Vista will not consider such an exit to be a failure.  On older versions
of Windows you should use "Suicide" instead.

If the value data is "Suicide" NSSM will simulate a crash and exit without
informing the service manager.  This option should only be used for
pre-Vista systems where you wish to apply a service recovery action.  Note
that if the monitored application exits with code 0, NSSM will only honour a
request to suicide if you explicitly configure a registry key for exit code 0.
If only the default action is set to Suicide NSSM will instead exit gracefully.


Removing services using the GUI

NSSM can also remove services.  Run

    nssm remove 

to remove a service.  You will prompted for confirmation before the service 
is removed.  Try not to remove essential system services...

Logging
-------
NSSM logs to the Windows event log.  It registers itself as an event log source
and uses unique event IDs for each type of message it logs.  New versions may
add event types but existing event IDs will never be changed.

Because of the way NSSM registers itself you should be aware that you may not
be able to replace the NSSM binary if you have the event viewer open and that
running multiple instances of NSSM from different locations may be confusing if
they are not all the same version.


Example usage

To install an Unreal Tournament server:

    nssm install UT2004 c:\games\ut2004\system\ucc.exe server

To remove the server:

    nssm remove UT2004 confirm


Building NSSM from source
-------------------------
NSSM is known to compile with Visual Studio 6, Visual Studio 2005 and Visual
Studio 2008.

NSSM will also compile with Visual Studio 2010 but the resulting executable
will not run on versions of Windows older than XP SP2.

The use of Software in systems and solutions that provide dedicated functionality (other than as mentioned above) or designed for use in embedded or function-specific software applications, for example but not limited to: Software embedded in or bundled with industrial control systems, wireless mobile telephones, wireless handheld devices, kiosks, TV/STB, Blu-ray Disc devices, telematics and network control switching equipment, printers and storage management systems, and other related systems are excluded from this definition and not licensed under this Agreement. “Programs” means (a) Java technology applets and applications intended to run on the Java Platform, Standard Edition platform on Java-enabled General Purpose Desktop Computers and Servers; and (b) JavaFX technology applications intended to run on the JavaFX Runtime on JavaFX-enabled General Purpose Desktop Computers and Servers. “Java SE LIUM” means the Licensing Information User Manual – Oracle Java SE and Oracle Java Embedded Products Document accessible at http://www.oracle.com/technetwork/java/javase/documentation/index.html. “Commercial Features” means those features that are identified as such in the Java SE LIUM under the “Description of Product Editions and Permitted Features” section.

2. LICENSE TO USE. Subject to the terms and conditions of this Agreement including, but not limited to, the Java Technology Restrictions of the Supplemental License Terms, Oracle grants you a non-exclusive, non-transferable, limited license without license fees to reproduce and use internally the Software complete and unmodified for the sole purpose of running Programs. THE LICENSE SET FORTH IN THIS SECTION 2 DOES NOT EXTEND TO THE COMMERCIAL FEATURES. YOUR RIGHTS AND OBLIGATIONS RELATED TO THE COMMERCIAL FEATURES ARE AS SET FORTH IN THE SUPPLEMENTAL TERMS ALONG WITH ADDITIONAL LICENSES FOR DEVELOPERS AND PUBLISHERS.

3. RESTRICTIONS. Software is copyrighted. Title to Software and all associated intellectual property rights is retained by Oracle and/or its licensors. Unless enforcement is prohibited by applicable law, you may not modify, decompile, or reverse engineer Software. You acknowledge that the Software is developed for general use in a variety of information management applications; it is not developed or intended for use in any inherently dangerous applications, including applications that may create a risk of personal injury. If you use the Software in dangerous applications, then you shall be responsible to take all appropriate fail-safe, backup, redundancy, and other measures to ensure its safe use. Oracle disclaims any express or implied warranty of fitness for such uses. This Agreement will terminate immediately without notice from Oracle if you fail to comply with any provision of this Agreement. Either party may terminate this Agreement immediately should any Software become, or in either party’s opinion be likely to become, the subject of a claim of infringement of any intellectual property right. Upon termination, you must destroy all copies of Software.

7. EXPORT REGULATIONS. You agree that U.S. export control laws and other applicable export and import laws govern your use of the Software, including technical data; additional information can be found on Oracle’s Global Trade Compliance web site (http://www.oracle.com/us/products/export). You agree that neither the Software nor any direct product thereof will be exported, directly, or indirectly, in violation of these laws, or will be used for any purpose prohibited by these laws including, without limitation, nuclear, chemical, or biological weapons proliferation.

8. TRADEMARKS AND LOGOS. You acknowledge and agree as between you and Oracle that Oracle owns the ORACLE and JAVA trademarks and all ORACLE- and JAVA-related trademarks, service marks, logos and other brand designations (“Oracle Marks”), and you agree to comply with the Third Party Usage Guidelines for Oracle Trademarks currently located at http://www.oracle.com/us/legal/third-party-trademarks/index.html. Any use you make of the Oracle Marks inures to Oracle’s benefit.

9. U.S. GOVERNMENT LICENSE RIGHTS. If Software is being acquired by or on behalf of the U.S. Government or by a U.S. Government prime contractor or subcontractor (at any tier), then the Government’s rights in Software and accompanying documentation shall be only those set forth in this Agreement.

10. GOVERNING LAW. This agreement is governed by the substantive and procedural laws of California. You and Oracle agree to submit to the exclusive jurisdiction of, and venue in, the courts of San Francisco, or Santa Clara counties in California in any dispute arising out of or relating to this agreement.

11. SEVERABILITY. If any provision of this Agreement is held to be unenforceable, this Agreement will remain in effect with the provision omitted, unless omission would frustrate the intent of the parties, in which case this Agreement will immediately terminate.

12. INTEGRATION. This Agreement is the entire agreement between you and Oracle relating to its subject matter. It supersedes all prior or contemporaneous oral or written communications, proposals, representations and warranties and prevails over any conflicting or additional terms of any quote, order, acknowledgment, or other communication between the parties relating to its subject matter during the term of this Agreement. No modification of this Agreement will be binding, unless in writing and signed by an authorized representative of each party.

SUPPLEMENTAL LICENSE TERMS

These Supplemental License Terms add to or modify the terms of the Binary Code License Agreement. Capitalized terms not defined in these Supplemental Terms shall have the same meanings ascribed to them in the Binary Code License Agreement. These Supplemental Terms shall supersede any inconsistent or conflicting terms in the Binary Code License Agreement, or in any license contained within the Software.

A. COMMERCIAL FEATURES. You may not use the Commercial Features for running Programs, Java applets or applications in your internal business operations or for any commercial or production purpose, or for any purpose other than as set forth in Sections B, C, D and E of these Supplemental Terms. If You want to use the Commercial Features for any purpose other than as permitted in this Agreement, You must obtain a separate license from Oracle.

B. SOFTWARE INTERNAL USE FOR DEVELOPMENT LICENSE GRANT. Subject to the terms and conditions of this Agreement and restrictions and exceptions set forth in the Java SE LIUM incorporated herein by reference, including, but not limited to the Java Technology Restrictions of these Supplemental Terms, Oracle grants you a non-exclusive, non-transferable, limited license without fees to reproduce internally and use internally the Software complete and unmodified for the purpose of designing, developing, and testing your Programs.

C. LICENSE TO DISTRIBUTE SOFTWARE. Subject to the terms and conditions of this Agreement and restrictions and exceptions set forth in the Java SE LIUM, including, but not limited to the Java Technology Restrictions and Limitations on Redistribution of these Supplemental Terms, Oracle grants you a non-exclusive, non-transferable, limited license without fees to reproduce and distribute the Software, provided that (i) you distribute the Software complete and unmodified and only bundled as part of, and for the sole purpose of running, your Programs, (ii) the Programs add significant and primary functionality to the Software, (iii) you do not distribute additional software intended to replace any component(s) of the Software, (iv) you do not remove or alter any proprietary legends or notices contained in the Software, (v) you only distribute the Software subject to a license agreement that: (a) is a complete, unmodified reproduction of this Agreement; or (b) protects Oracle’s interests consistent with the terms contained in this Agreement and that includes the notice set forth in Section H, and (vi) you agree to defend and indemnify Oracle and its licensors from and against any damages, costs, liabilities, settlement amounts and/or expenses (including attorneys’ fees) incurred in connection with any claim, lawsuit or action by any third party that arises or results from the use or distribution of any and all Programs and/or Software. The license set forth in this Section C does not extend to the Software identified in Section G.

D. LICENSE TO DISTRIBUTE REDISTRIBUTABLES. Subject to the terms and conditions of this Agreement and restrictions and exceptions set forth in the Java SE LIUM, including but not limited to the Java Technology Restrictions and Limitations on Redistribution of these Supplemental Terms, Oracle grants you a non-exclusive, non-transferable, limited license without fees to reproduce and distribute those files specifically identified as redistributable in the Java SE LIUM (“Redistributables”) provided that: (i) you distribute the Redistributables complete and unmodified, and only bundled as part of Programs, (ii) the Programs add significant and primary functionality to the Redistributables, (iii) you do not distribute additional software intended to supersede any component(s) of the Redistributables (unless otherwise specified in the applicable Java SE LIUM), (iv) you do not remove or alter any proprietary legends or notices contained in or on the Redistributables, (v) you only distribute the Redistributables pursuant to a license agreement that: (a) is a complete, unmodified reproduction of this Agreement; or (b) protects Oracle’s interests consistent with the terms contained in the Agreement and includes the notice set forth in Section H, (vi) you agree to defend and indemnify Oracle and its licensors from and against any damages, costs, liabilities, settlement amounts and/or expenses (including attorneys’ fees) incurred in connection with any claim, lawsuit or action by any third party that arises or results from the use or distribution of any and all Programs and/or Software. The license set forth in this Section D does not extend to the Software identified in Section G.

E. DISTRIBUTION BY PUBLISHERS. This section pertains to your distribution of the JavaTM SE Development Kit Software (“JDK”) with your printed book or magazine (as those terms are commonly used in the industry) relating to Java technology (“Publication”). Subject to and conditioned upon your compliance with the restrictions and obligations contained in the Agreement, Oracle hereby grants to you a non-exclusive, nontransferable limited right to reproduce complete and unmodified copies of the JDK on electronic media (the “Media”) for the sole purpose of inclusion and distribution with your Publication(s), subject to the following terms: (i) You may not distribute the JDK on a stand-alone basis; it must be distributed with your Publication(s); (ii) You are responsible for downloading the JDK from the applicable Oracle web site; (iii) You must refer to the JDK as JavaTM SE Development Kit; (iv) The JDK must be reproduced in its entirety and without any modification whatsoever (including with respect to all proprietary notices) and distributed with your Publication subject to a license agreement that is a complete, unmodified reproduction of this Agreement; (v) The Media label shall include the following information: “Copyright [YEAR], Oracle America, Inc. All rights reserved. Use is subject to license terms. ORACLE and JAVA trademarks and all ORACLE- and JAVA-related trademarks, service marks, logos and other brand designations are trademarks or registered trademarks of Oracle in the U.S. and other countries.” [YEAR] is the year of Oracle’s release of the Software; the year information can typically be found in the Software’s “About” box or screen. This information must be placed on the Media label in such a manner as to only apply to the JDK; (vi) You must clearly identify the JDK as Oracle’s product on the Media holder or Media label, and you may not state or imply that Oracle is responsible for any third-party software contained on the Media; (vii) You may not include any third party software on the Media which is intended to be a replacement or substitute for the JDK; (viii) You agree to defend and indemnify Oracle and its licensors from and against any damages, costs, liabilities, settlement amounts and/or expenses (including attorneys’ fees) incurred in connection with any claim, lawsuit or action by any third party that arises or results from the use or distribution of the JDK and/or the Publication; ; and (ix) You shall provide Oracle with a written notice for each Publication; such notice shall include the following information: (1) title of Publication, (2) author(s), (3) date of Publication, and (4) ISBN or ISSN numbers. Such notice shall be sent to Oracle America, Inc., 500 Oracle Parkway, Redwood Shores, California 94065 U.S.A , Attention: General Counsel.

F. JAVA TECHNOLOGY RESTRICTIONS. You may not create, modify, or change the behavior of, or authorize your licensees to create, modify, or change the behavior of, classes, interfaces, or subpackages that are in any way identified as “java”, “javax”, “sun”, “oracle” or similar convention as specified by Oracle in any naming convention designation.

G. LIMITATIONS ON REDISTRIBUTION. You may not redistribute or otherwise transfer patches, bug fixes or updates made available by Oracle through Oracle Premier Support, including those made available under Oracle’s Java SE Support program.

H. COMMERCIAL FEATURES NOTICE. For purpose of complying with Supplemental Term Section C.(v)(b) and D.(v)(b), your license agreement shall include the following notice, where the notice is displayed in a manner that anyone using the Software will see the notice:

Use of the Commercial Features for any commercial or production purpose requires a separate license from Oracle. “Commercial Features” means those features that are identified as such in the Licensing Information User Manual – Oracle Java SE and Oracle Java Embedded Products Document, accessible at http://www.oracle.com/technetwork/java/javase/documentation/index.html, under the “Description of Product Editions and Permitted Features” section.

K. TERMINATION FOR INFRINGEMENT. Either party may terminate this Agreement immediately should any Software become, or in either party’s opinion be likely to become, the subject of a claim of infringement of any intellectual property right.

L. INSTALLATION AND AUTO-UPDATE. The Software’s installation and auto-update processes transmit a limited amount of data to Oracle (or its service provider) about those specific processes to help Oracle understand and optimize them. Oracle does not associate the data with personally identifiable information.
